The Failure of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the announcement of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been contained. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the grim essence of the recent timeframe. By day, political struggles are waged: positive announcements are issued from different nations. Significant resources is allocated on containing certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was revealed. Ukraine is capable of detecting projectile deployments from enemy soil, a ability afforded by timely intelligence. From vantage locations, defense planes that had been dispatched to counter approaching aerial threats flew past – modern combat jets supplied to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense thundered: multiple launches targeted at a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by partner states. Every firing jolts you unexpectedly, shaking the windows. The moment of terror quickly gives way to sober acceptance: maybe the approaching threat won't strike its target this time, preventing destruction from catastrophe and another blackout.

Continuous Dangers

Not long after, a large-caliber weapon engaged a unmanned aircraft somewhere nearby, part of a mobile-fire group – most likely allied-provided weaponry. Unfortunately, the bullets missed the enemy aircraft – it continued its flight toward its destination.

Intermittently, this carried on until dawn. Kyiv greeted the early updates: multiple fatalities, devastation and heating outages in multiple buildings as a result of the evening attack. As always, everyone still continued their routines – experiencing conflict. But those full day demonstrated Ukraine's critical military reliance on Western support – a dependence that European nations are clearly incapable to fill in the short term.

Failed Diplomacy

The detailed framework from Washington sparked intense emotion, debate and serious worry – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new initiative from American administration adheres to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They manage the tension but never actually achieve victory. This pattern will, no doubt, endure.

Strategic Calculations

It is convenient to criticize specific actors of persistently promoting Russian terms. But that does not seem to be the complete picture. Washington functions according to a assumption well known to seasoned negotiators: you cannot achieve through diplomacy what you have failed to defend militarily. The US administration believes that it is impossible to pressure the Kremlin to relinquish the areas that it presently holds in Ukraine's occupied territories.

The challenge is that while acknowledging this situation, Washington does little to deter Moscow, through words or deeds, from assuming that the situation will not shift further in its favour in the months ahead.

Divergent Views

Therefore, Moscow is certain that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their reason to accept conditions that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to end hostilities, but they will persist as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, progressively conceding lives and land but preventing a total frontline collapse until situations evolve in its advantage.

Existing Situation

Factually, there are no genuine requirements for a armistice. Now, subjective factors are entering the equation: personal goals to broker a ceasefire and secure international recognition, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any proposal Kyiv finds unworkable, so that their priority does not shift toward domestic problems. And although their mission will now be significantly challenging after recent developments, it remains very improbable that this will modify their basic position.

These two forces are driving the talks.

Assessment and Future

It took a only one week to terminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the rest of Europe, along with pacifying measures of negotiators, and finally, recent disclosures, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are founded on Moscow's terms and show particular unwillingness to modify developments, if they remain united and improve their protective measures at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the coming months, largely rely on ongoing international assistance.
